What is an Enduring Power of Attorney

( EP of A)?

An enduring power of attorney is a written legal document appointing and authorising another person, the attorney, to act on your behalf and manage your legal and financial affairs during your life time .

The person making the appointment is known as the principal.

At the time of making the Power of Attorney, the principal must have mental capacity.

After the Power of Attorney has been signed by the principal an enduring power of attorney  can take effect when you, the principal, loses mental capacity.

Your attorney should be someone you trust and is responsible.

Who should make an Power of Attorney?

Anyone over 18 years of age and who has mental capacity can make a Power of Attorney. It is important to have a Power of Attorney as part of your financial planning.

What does an Attorney for take care of?

For example an  attorney appointed under a Power of Attorney can do things such as:

  • 1. deal with your super fund
  • 2. deal with Centrelink
  • 3. prepare your tax returns
  • 4. managing your investments

Can an Attorney deal with health and lifestyle choices?

An Attorney under a Power of Attorney cannot make decisions about medical decisions and treatment or where you will live or other lifestyle choices.

For medical and lifestyle choices a document appointing a guardian is required.
